This report summarises the content of agenda items 6 and 7 which, in the opinion of the proper officer, contain exempt information within one of the categories in Schedule 12A of the Local Government Act 1972. It is a matter for the Sub-Committee to determine whether the press and public should be excluded from the meeting during consideration of documents.

 

Minutes:

The Sub-Committee agreed to exclude the press and public from the meeting during consideration of agenda items 6 and 7 because consideration of this matter in public would disclose information falling within paragraphs 1, 2 and 5 of Part 1 of Schedule 12A of the Local Government Act 1972 as specified in agenda item 5 (Exclusion of press and public) and, in all the circumstances of the case, the Sub-Committee considered that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.

Appeal against revocation of Hackney Carriage Driver Licence

To consider an appeal against the revocation of a Hackney Carriage Driver Licence.

The Sub-Committee considered an appeal from Mr B against the revocation of his Hackney Carriage Driver Licence.

 

Decision:

 

After careful consideration of the written evidence and the representations made at the meeting, the Sub-Committee refused Mr B’s appeal against the revocation of his Hackney Carriage Driver Licence. The decision was made in the light of the lack of a valid DBS due to a pending court case and the requirement to have a valid DBS to comply with the council’s Hackney Carriage and Private Hire Policy.

The Sub-Committee determined an application for a Hackney Carriage Driver Licence from Mr M and considered whether he should be granted an exemption from driving a wheelchair accessible vehicle.

 

Decision:

 

After careful consideration of the written evidence and the representations made at the meeting, the Sub-Committee determined that Mr M could be granted a Hackney Carriage Driver Licence however he would not be granted a medical exemption or vehicle exemption based on the evidence provided and would therefore need to comply with the Hackney Carriage and Private Hire Policy and drive a wheelchair accessible vehicle.
