To elect the Chairperson and Vice-Chairperson of the Licensing Sub-Committee of the Licensing and Safety Committee for the 2023/2024  municipal year. 

The Sub-Committee elected Councillor McDonald as Chairperson and Councillor Browne as Vice Chairperson for the 2023/2024 Municipal year.

 Apologies for absence were received from Councillor Kemp and Councillor Mark Prenter.

To approve the record of the meeting held on 3 February 2023.

The record of the meeting held on 3 February 2023 was agreed and signed by the Chairperson.

This report summarises the content of agenda item 7, which, in the opinion of the proper officer, contains exempt information within one of the categories in Schedule 12A of the Local Government Act 1972. It is a matter for the Sub-Committee to determine whether the press and public should be excluded from the meeting during consideration of documents.

The Sub-Committee agreed to exclude the press and public from the meeting during consideration of agenda item 7 because consideration of this matter in public would disclose information falling within paragraphs 1, 2 and 5 of Part 1 of Schedule 12A of the Local Government Act 1972 as specified in agenda item 5 (Exclusion of press and public) and, in all the circumstances of the case, the Sub-Committee considered that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.

The Licensing Sub Committee is requested to consider an appeal against the revocation and refusal to renew a Hackney Carriage Driver Licence.

Discussion:

The Sub-Committee considered an appeal from Ms H against the revocation and refusal to renew Ms H’s Hackney Carriage Driver Licence. The Sub-Committee acknowledged that no mistakes had been made by the Licensing Team in reaching their decision to revoke Ms H’s Hackney Carriage Driver Licence based on the evidence received at the time.

Decision:

After careful consideration of the written evidence including additional evidence provided during the meeting and representations made at the meeting, the Sub-Committee decided to uphold the appeal against the revocation and refusal to renew and confirmed that Ms H’s Hackney Carriage Driver Licence would now be renewed.
