Summary

This report will seek authority for the Council to make a formal undertaking to the NHS that it will make up the potential VAT shortfall in relation to the construction of the Healthy Living Centre, to which the Leader’s approval under urgency provisions is sought.

The Chief Executive will also be asked to use separate non-executive urgency provisions to agree the budgetary impact of the of the proposal. The use of these urgency provisions will be reported to Full Council on 20 July 2023 for information.

On this occasion it has not been possible to provide 28 clear days’ notice, nor 5 clear days’ notice, therefore Section 11 (Cases of special urgency) of the Local Authorities (Executive Arrangements)(Meetings and Access to Information)(England) Regulations 2012 and Rule 17 (Special urgency) of the Council’s Access to Information Rules, as set out in the Constitution, have been complied with. The Chairman of the Business Support Overview and Scrutiny Committee has agreed that the taking of these decisions are urgent and cannot be reasonably deferred until the next Cabinet meeting on 11 July 2023. This is because delaying the approval of this financial commitment to the Cabinet meeting on 11 July will delay the submission by the Integrated Care Board of their Open Business Case.
