Decision:

The Cabinet agreed to allow MHS to vary the restrictive covenant contained in the transfer of land adjacent to 32 Mallard Way to permit the land to be used for the construction of a pair of semi detached houses as approved under planning permission reference MC/2000/1476 for the consideration set out in the report.

Reasons for the decision:

There are no sustainable reasons for the covenant to be enforced and this is an opportunity for the Council to receive a capital receipt.
