Decision:

158/2009 The Cabinet instructed officers to re-open the competitive dialogue for the residual waste disposal contract and ask the bidders to re-submit fresh final tenders.
159/2009 The Cabinet agreed that a capped liability on termination of at least three years unitary charge is an acceptable contract term.
160/2009 The Cabinet instructed officers to re-open the restricted procedure for the residual waste/recycling collection and street cleansing contract to clarify the terms upon which variant bids may be acceptable and ask the bidders to re-submit fresh final tenders.
161/2009 The Cabinet agreed to re-affirm the award of the contract for green waste processing to Countrystyle with a commencement date to be determined by Cabinet.
162/2009 The Cabinet asked the Chief Executive to instigate a full investigation of the circumstances in which these errors arose, and to take appropriate action.

Reasons for the decision:

The recommendations support the advice received from both Ernst & Young and Eversheds, and help to reduce the likelihood of a successful challenge from contractors, whilst ensuring that the Council receives best value from its procurements.
