679LICENSING ACT 2003 - PROGRESS REPORT ON IMPLEMENTATION
 Discussion:
 
The Licensing Manager updated the committee on the details of the applications received since the agenda was printed.

The committee was also informed that there had been a 60% response rate to the mailshot sent to all takeaways and off-licence premises. Officers were now beginning a series of visits to premises that had not responded to the mailshot.

 Decision:
 
The committee noted the report and the areas of concern highlighted in paragraphs 4.5 and 5.1.
680LICENSING ACT 2003 - GUIDELINES FOR HEARING OF APPLICATIONS
 Discussion:
 
At the last meeting of the committee, when draft regulations were in circulation, members agreed a procedure to be used at a Licensing Hearing Panel meeting which broadly followed the system currently used in a magistrates' court. Since then, the final regulations have been published and state that a hearing should take the form of a discussion.

 Decision:
 
The committee agreed:
 (i)that applications may be determined by either written representation or by a full hearing, as deemed appropriate by the Licensing Manager in accordance with the provisions of the Licensing Act 2003;
 (ii)that the guidelines shown at Appendix A are approved with the amendment of no. 2 as follows:

681APPOINTMENT OF VICE-CHAIRMEN AND ESTABLISHMENT OF LICENSING HEARING PANELS FOR MAY-JULY 2005
 Discussion:
 
The committee discussed the vacancies within the current schedule of Licensing Hearing Panels and members offered further availability once applications were set to specific hearing dates.
Members requested information about the feasibility of site visits before a panel hearing.

 Decision:
 
The committee
 (i)approved the appointment of seven Vice-Chairmen, as set out in paragraph 4.2 of the report, subject to their attendance at a suitable training course;
 (ii)adopted the rules regulating the appointment of Chairmen for Licensing Hearing Panels, as set out in paragraph 4.1 of the report;
 (iii)noted the timetable of Licensing Hearing Panels and their membership for the period May-July 2005, as set out in Appendix A;
 (iv)requested officers to investigate the possibility of holding site visits before a hearing and, if appropriate, the criteria for a site visit and a code of conduct for such visits.
