This report summarises the content of agenda items 6, 7 and 8 which, in the opinion of the proper officer, contain exempt information within one of the categories in Schedule 12A of the Local Government Act 1972. It is a matter for the Sub-Committee to determine whether the press and public should be excluded from the meeting during consideration of these documents.

The Sub-Committee agreed to exclude the press and public from the meeting during consideration of agenda items 6, 7 and 8 because consideration of these matters in public would disclose information falling within paragraphs 1, 2 and 5 of Part 1 of Schedule 12A of the Local Government Act 1972 as specified in agenda item 5 (Exclusion of press and public) and, in all the circumstances of the cases, the Sub-Committee considered that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.

Appeal against revocation of Hackney Carriage and Private Hire Driver Licence

The purpose of this report is to request that the Licensing Sub-Committee consider an appeal against the revocation of a Hackney Carriage and Private Hire Driver Licence.

The Sub-Committee considered an appeal against the revocation of a Hackney Carriage and Private Hire Driver Licence.

 

Decision:

 

After careful consideration of the written evidence and the representations made at the meeting, the sub-committee determined that the appellant should be given 6 points for a road traffic violation and 6 points for failure to comply with the Medway Hackney Carriage and Private Hire Licensing Policy in relation to reporting requirements and for driving a vehicle that was a non-wheelchair accessible vehicle.

Appeal against revocation and refusal to renew a Private Hire Driver Licence

The purpose of this report is to request that the Licensing Sub-Committee consider an appeal against the revocation and refusal to renew a restricted Private Hire Driver Licence.

The Sub-Committee considered an appeal against the revocation and refusal to renew a Private Hire Driver Licence.

 

Decision:

 

After careful consideration of the written evidence and oral representations made at the meeting, the Licensing Sub-Committee determined that the appellant should be given 6 points for speeding offences and 6 points for the failure to disclose speeding offences and for failure to update the DBS Update Service.

Appeal against penalty points issued and review of Private Hire Driver Licence

The Licensing Sub-Committee are requested to consider the appeal submitted against the issuing of 12 penalty points and, should the appeal be dismissed, to consider the continuance of a Private Hire Driver Licence and determine what action should be taken.

After careful consideration of the written evidence and oral representations made at the meeting, the Licensing Sub-Committee decided to uphold the appeal and remove the 12 penalty points that had been imposed.
