Councillor Mrs Diane Chambers was elected Chairman of the Sub-Committee for the 2021/22 municipal year.

To elect a Vice-Chairman of the Licensing Sub-Committee of the Licensing and Safety Committee for the 2021/22 municipal year.

Councillor Fearn was elected as Vice-Chairman of the Sub-Committee for the 2020/21 municipal year.

This report summarises the content of agenda item 8, which, in the opinion of the proper officer, contains exempt information within three of the categories in Schedule 12A of the Local Government Act 1972. It is a matter for the Sub-Committee to determine whether the press and public should be excluded from the meeting during consideration of documents.

Minutes:

The Sub-Committee agreed to exclude the press and public from the meeting during consideration of agenda item 8 because consideration of this matter in public would disclose information falling within paragraphs 1, 2 and 5 of Part 1 of Schedule 12A of the Local Government Act 1972 as specified in agenda item 7 (Exclusion of press and public) and, in all the circumstances of the case, the Sub-Committee considered that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.

Appeal against revocation of a Hackney Carriage Driver Licence

The purpose of this report is to request that the Licensing Sub-Committee consider an appeal against the revocation of a Hackney Carriage Driver Licence.

Discussion:

 

The Licensing Manager advised the Sub-Committee of the circumstances of the case and took Members through the documents that were included in the agenda report, responding to Members’ questions.

 

She called Mr L as a witness and he gave a statement and responded to Members’ questions.

 

Decision:

 

After careful consideration of the written evidence and the representations made at the meeting, the Sub-Committee refused Mr K’s appeal against the revocation of his Hackney Carriage Driver Licence. The decision was made in the light of the medical evidence submitted and in the absence of any medical evidence to counter this.

 

The Sub-Committee noted that Mr K had been invited to attend the meeting to present his appeal but had chosen not to attend.
