To elect the Chairman and Vice-Chairman of the Licensing Sub-Committee of the Licensing and Safety Committee for the 2020/2021 municipal year. 

Councillor Mrs Diane Chambers was elected Chairman and Councillor Fearn was elected Vice-Chairman for the 2020/21 Municipal Year.

An apology for absence was received from Councillor Bhutia.

To approve the record of the meeting held on 2 February 2019.

The record of the meeting held on 8 February 2019 was agreed and signed by the Chairman as correct.

This report summarises the content of agenda item 7, which, in the opinion of the proper officer, contains exempt information within three of the categories in Schedule 12A of the Local Government Act 1972. It is a matter for the Sub-Committee to determine whether the press and public should be excluded from the meeting during consideration of this item.

Decision:

The Sub-Committee agreed to exclude the press and public from the meeting during consideration of agenda item 7 because consideration of this matter in public would disclose information falling within paragraphs 1, 2 and 5 of Part 1 of Schedule 12A of the Local Government Act 1972 as specified in agenda item 6 (Exclusion of press and public) and, in all the circumstances of the case, the Sub-Committee considered that the public interest in maintaining the exemption outweighed the public interest in disclosing the information. 

The purpose of this report is to request that the Licensing Sub-Committee considers an appeal against the Council’s refusal to grant a Private Hire Driver Licence.

Discussion:

The Licensing Manager advised the Sub-Committee of the circumstances of the case.

Mr K addressed the Sub-Committee to make representations in mitigation and respond to questions from members of the Sub-Committee.

Decision:

After careful consideration of the written evidence and the representations made at the meeting, the Sub-Committee agreed to grant Mr K a Private Hire Driver Licence for a period of one year, after which, provided there are no further issues, his licence will be renewed in line with the agreed renewal application procedure.
