Transfer of Grounds Maintenance Services to Medway Norse

Summary

The Cabinet will be asked to agree to transfer the grounds maintenance services to a division of Medway Norse rather than establish a subsidiary company, as originally agreed by Cabinet on 29 October 2013.

It is noted that the Local Authorities (Executive Arrangements)(Meetings and Access to Information)(England) Regulations 2012 requires 28 clear days’ notice of the intention to make a key decision. On this occasion it has not been possible to provide this 28 clear days’ notice, therefore, section 10 (General Exception) of the above regulations has been complied with for the following reason: Negotiations around the financial model were ongoing and led to a conclusion that changed the (legal) entity to which the activities would be transferred.  The specification and related outcomes planned at the outset remain unchanged.
